These Terms of Service ("Terms") govern your access to and use of the Pretty Smile Dental Clinic website at getprettysmile.com (the "Site") and any related services we provide. By using the Site, you agree to these Terms. If you do not agree, do not use the Site.

1. About Pretty Smile

Pretty Smile Dental Clinic ("Pretty Smile," "we," "us," or "our") is a dental clinic located at Blvd. Abelardo L. Rodríguez #800-F, Col. Calles, Plaza Noreste, Mexicali, Baja California 21226, Mexico. We are licensed to practice dentistry in Mexico. Our dentists hold professional licenses (cédulas profesionales) issued by Mexican authorities. We are not licensed to practice dentistry in the United States, Canada, or any other country outside of Mexico.

2. The Website is Informational

The Site provides general information about our clinic, services, pricing ranges, and the cross-border dental care experience. The Site is not a substitute for an in-person consultation, diagnosis, or treatment plan from a licensed dentist.

No content on the Site constitutes dental, medical, legal, financial, or other professional advice. Always consult a licensed professional before making decisions about your dental care.

3. Quotes, Estimates, and Pricing

• Any quote, price, or estimate provided through the Site, WhatsApp, email, or phone is a preliminary estimate only, based on the information you share. It is not a binding contract or guarantee of final price.
• Final pricing is determined after an in-person consultation, x-rays, and clinical examination at our Mexicali location.
• Prices are quoted in U.S. dollars (USD) for convenience but are payable in Mexican pesos (MXN) at the current exchange rate, in accordance with Mexican law.
• Savings comparisons (e.g., "save up to 70%") are based on average published prices for equivalent treatments in the United States as of the most recent industry surveys we reviewed. Your specific savings will depend on your treatment plan, location, and any U.S. dental insurance benefits you have.
• Quotes are valid for the period specified in the quote (typically 30–60 days), after which they may be revised.

4. Appointments and Cancellations

• Appointments must be confirmed in writing (WhatsApp or email) at least 48 hours in advance.
• Cancellations made less than 48 hours before a scheduled appointment may be subject to a rescheduling fee.
• If we need to reschedule due to clinic capacity, weather, or border conditions, we will notify you as soon as possible and offer alternative dates.
• Our optional shuttle service from the Calexico border is provided on a scheduled basis and depends on advance reservation.

5. Treatment Outcomes and Disclaimers

Dental treatment outcomes depend on your individual oral health, bone density, healing capacity, post-treatment care, lifestyle factors, and other variables beyond our control. While we strive for excellent results in every case, we do not guarantee specific outcomes.

Results may vary. Testimonials, reviews, and before/after photos shown on the Site represent the experiences of specific patients and are not representative or predictive of every patient's experience.

6. Warranty

For qualifying treatments, Pretty Smile provides a written warranty (signed at the time of treatment) covering certain failures within a defined period. Specifically:

• Dental implants and crowns: 5-year warranty for failure under normal use, when the patient follows the prescribed post-treatment care and attends recommended follow-up visits at our clinic.

The warranty does not cover damage caused by accidents, trauma, failure to follow post-care instructions, untreated periodontal disease, smoking, bruxism without protective treatment, or treatments performed by other providers. Full warranty terms are provided in writing at the time of treatment and supersede this summary.

7. Travel, Visas, and Border Crossing

You are responsible for your own travel arrangements, passport, visa requirements, transportation, accommodations, and any costs associated with crossing the United States–Mexico border. We can provide general guidance about the Calexico–Mexicali crossing and our shuttle service, but we do not provide legal travel or immigration advice. Check current U.S. State Department and Mexican government guidance before traveling.

8. Insurance

Pretty Smile does not directly bill U.S. or Canadian dental insurance. We provide itemized invoices in English with U.S.-recognized CDT codes that you can submit to your insurer for possible out-of-network reimbursement. We make no representation that your insurer will reimburse any portion of your treatment, and reimbursement is solely between you and your insurer.

9. Photos, Testimonials, and User Content

If you submit a photo, video, testimonial, or other content to us (whether through the Site, WhatsApp, or otherwise), you grant Pretty Smile a non-exclusive, royalty-free, worldwide license to use, reproduce, and display that content for marketing and promotional purposes, with appropriate attribution if requested. You can revoke this permission at any time by contacting us, and we will remove the content from future marketing materials within a reasonable period.

You represent that any content you submit is yours to share and does not infringe the rights of any third party.

10. Intellectual Property

All content on the Site — including text, images, logos, design, and code — is owned by Pretty Smile Dental Clinic or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not copy, reproduce, distribute, modify, or create derivative works without our prior written permission, except for personal, non-commercial reference.

11. Acceptable Use

When using the Site, you agree not to:

• Use the Site for any unlawful purpose or in violation of these Terms.
• Attempt to gain unauthorized access to the Site, our systems, or any patient information.
• Impersonate any person or entity.
• Submit false, misleading, defamatory, or harassing content.
• Interfere with the operation of the Site (e.g., scraping at scale, denial-of-service attempts, automated bots without permission).

12. Third-Party Links and Services

The Site contains links to third-party websites and services (e.g., WhatsApp, Google Maps, Meta, Google). We are not responsible for the content, accuracy, or practices of those third parties. Your interactions with them are governed by their own terms and privacy policies.

13. Limitation of Liability

To the maximum extent permitted by applicable law:

• The Site and the content on it are provided "as is" and "as available," without warranties of any kind, whether express or implied.
• Pretty Smile is not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or any information obtained through the Site.
• Our total liability for any claim arising from the Site is limited to the amount you paid us in the 12 months preceding the claim (which, for Site use alone, is typically zero).
• Nothing in these Terms limits liability that cannot be limited under applicable law (e.g., gross negligence, willful misconduct, fraud).

Liability arising from actual dental treatment performed at our clinic is governed by Mexican law and the specific treatment consent forms you sign at the time of care.

14. Indemnification

You agree to indemnify and hold Pretty Smile harmless from any claims, damages, or expenses (including reasonable attorney's fees) arising from your violation of these Terms or your misuse of the Site.

15. Governing Law and Jurisdiction

These Terms are governed by the laws of the United Mexican States, specifically the State of Baja California, without regard to conflict of law principles. Any dispute arising from these Terms or your use of the Site shall be brought exclusively in the competent courts of Mexicali, Baja California, Mexico, and you consent to personal jurisdiction there.

This choice of law and venue clause does not deprive you of any rights you have under the consumer protection laws of your home country that cannot be contractually waived.

16. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the "Last Updated" date at the top of this page. For material changes, we will provide additional notice on the Site. Your continued use of the Site after changes are posted means you accept the updated Terms.

17. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
